Acceptable Use Policy

By subscribing to, or utilizing, Y2k Service, Inc.("Y2k Service") web hosting or any related Service or Servers, you agree to abide by this Acceptable Use Policy.

Your utilization of Y2k Service's service or servers constitutes your express agreement to abide by this Acceptable Use Policy The Rules, as the same may be changed from time-to-time by Y2k Service, at its sole and absolute discretion. These Rules are designed to enhance the quality of our Web Hosting services and to protect our customers, and the Internet community as a whole, from illegal, irresponsible, or disruptive Internet activities. These Rules apply to all customers of Y2k Service. We hope and expect that common sense and good judgment will guide all of our customers' use of our Y2k Service's service or servers. Even with such Rules in effect, minors should be supervised when using the Internet. Adults and minors should be aware of what is on the Internet and to understand the concept of what is accepted and what should be avoided. The following non-exhaustive list details the kinds of illegal or harmful conduct, which are prohibited. Y2k Service reserves the right to restrict or prohibit any and all uses of its services or content on your Web site and to remove such materials, including your website, from its servers at any time Y2k Service determines in its sole discretion that such content or materials violates this Acceptable Use Policy, is illegal, or is harmful to its servers, systems, network, reputation, good will, other Y2k Service customers, or any third party. Depending on the severity of the violation and the history of your account, Y2k Service may take any reasonable disciplinary action it determines in its sole and absolute discretion, including, but not limited to, one or more of the foregoing or following actions: (a) issuance of a verbal or written warning; (b) suspension of your account; (c) termination of your account; (c) billing for administrative and legal costs and fees and/or reactivation costs. All of the foregoing rights are cumulative, and the exercise of any right at any time shall not preclude the exercise of any other right, or the same right, at any other time for the same violation or any subsequent violation.

Your data is secure and protected from fraud and other security threats. Our systems are compliant with the strict guidelines outlined in the Payment Card Industry Data Security Standards (PCI DSS).

Late & Overdue balances

Customers, please adhere to the following: If balance is outstanding for five (5) days or more, your website will be deactivated. Your website will stay off until your account is brought current. There will be a reactivation fee of $35.00 or 5% of the unpaid invoices (whichever is greater) on each site that has to be reactivated.

An interest equal to 1.5% per month or the maximum provided by law (whichever is less) will be applied to invoice amount(s) that are PAST DUE. Should customer default in any payment(s), Y2k Service, Inc. shall have the right , without notice to customer, to declare all invoice(s) amount due and payable. In the event Y2k Service, Inc. should commence any action or actions or otherwise seek to enforce this collection, customer agrees to pay reasonable attorney(s) fees, court and other expenses incurred by Y2k Service, Inc. whether or not the suit is filed.

Recurring payments

1) month to month Subscription (is an annual subscription) customers must give a 30 day notice it is your responsibility and is required prior to cancelation, if not the monthly billing will continue until 30 day notice is given and all fees are due no mater if the service was used or not. The amount of time on your account will be calculated from date of notice to end of subscription and a cancelation fee not more than 50% of the balance of the annual subscription is due. Your failure to give your 30 day notice will be deemed acceptance of the renewal subscription term.

2) Quarterly Subscription (is an annual subscription) customers must give a 30 day notice it is your responsibility and is required prior to cancelation, if not the quarterly billing will continue until 30 day notice is given and all fees are due no mater if the service was used or not. The amount of time on your account will be calculated from date of notice to end of subscription and a cancelation fee not more than 50% of the balance of the annual subscription is due. Your failure to give your 30 day notice will be deemed acceptance of the renewal subscription term.

3) Annual Subscription (is an annual subscription, this is if a customer choose to pay monthly or quarterly or yearly) customers must give a 30 day notice is required prior to cancelation, if not the billing will continue until 30 day notice it is your responsibility and is given and all fees are due no mater if the service was used or not. The amount of time on your account will be calculated from date of notice to end of subscription and a cancelation fee not more than 50% of the balance of the annual subscription is due. Your failure to give your 30 day notice will be deemed acceptance of the renewal subscription term.

Storage and Security

At all times, customer shall bear full risk of loss and damage to its web site and all of its content. Customers are entirely responsible for maintaining the confidentiality of their password and account information.

Y2k Service, Inc. shared hosting servers are not an archive and Y2k Service, Inc. shall have no liability to customers or any other person for loss, damage or destruction of any of customerís content.

If customer purchase managed backup, customer hereby authorize Y2k Service, Inc. to log into customer server for purposes of installing and configuring the software.

In the event customer terminates, moves their web site off of Y2k Service, Inc shared hosting servers is the customerís responsibility. Y2k Service, Inc. will not transfer or FTP customerís web site to another provider. In the event customer use of the services is terminated, Y2k Service, Inc. will not transfer or manage customerís services or web site content. All Y2k Service, Inc. services are AS Services. Customer acknowledges and agrees Y2k Service, Inc. has no control

Illegal or Improper Activities

You may not use Y2k Service's service or servers in any manner in violation of any state, local or federal law of the United States of America, or any of its states or which in any manner is in violation of any applicable local or national law of any country. Such violations and activities include, but are not limited to, violations of U.S. or other applicable foreign export laws or restrictions including the U.S. Export Administration Act and accompanying regulations, posting or trafficking in government secrets, providing any information to in any way assist or encourage any terrorist activities, providing any information concerning nuclear or biological weapons or other weapons of mass destruction, posting or trafficking in obscene material, solicitation of a minor or others for illegal acts, dealing drugs, harassment, fraud, stalking, abuse, or other subject matters that are prohibited under applicable federal, state, local or Foreign law.

Dangerous Activities

You may not use Y2k Service's service or servers to post or disseminate in any manner, any information or material which may be dangerous, damaging or injurious to persons or property or which, directly or indirectly, may be used to create danger, damage or injury to persons or property.

Infringement

You may not use Y2k Service's service or servers in any manner which infringes the intellectual property rights or other proprietary rights of any third party including, without limitation, material protected by copyright, trademark, patent, trade secret, or other intellectual property right used without proper authorization. Infringement may result from, among other activities, the unauthorized copying and posting of pictures, logos, software, articles, musical works, and videos.

Fradulent Activities

You may not offer or disseminate fraudulent goods, services, schemes, or promotions (i.e., make money fast schemes, chain letters, pyramid schemes, ponzi schemes), or furnish false data on any signup form, contract or online application or registration, or fraudulently use any information obtained through the use of Y2k Service's servers or services, including without limitation use of credit card numbers.

Offensive Subject Matter

You may not use Y2k Service's service or servers for transmitting, disseminating, sale, storage or hosting subject matter that is unlawful, libelous, defamatory, obscene, pornographic, adult material, liquor, tobacco, fire arms, indecent, lewd, filthy, excessively violent, harassing, threatening, hateful, harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable. You may not use Y2k Service's services or servers to conduct any sexually oriented business or disseminate pornographic pictures, videos, banners, text or any similar material. You may not use Y2k Service's services or servers to threaten bodily harm or destruction of property.

Harmful Activities

You may not use Y2k Service's service or servers for disseminating or hosting harmful content including, without limitation, viruses, Trojan horses, worms, time bombs, cancel bots or any other computer programming routines that may damage, interfere with, surreptitiously intercept or expropriate any system, program, data or personal information.

Tortous Activities

You may not use Y2k Service's service or servers for any tortuous conduct, including, but limited to, posting defamatory, libelous, slanderous, scandalous, or private information about a person or company without their consent; intentionally inflicting emotional distress; making unlawful threats; stalking, interfering with any contract or prospective economic relations; engaging in fraud or deception; engaging in sexual or other harassment; or for violating any patents, trademarks, copyrights, or other intellectual property rights.

Abusive Activities

You may not use Y2k Service's service or servers for any abusive activities on the Internet, including, but not limited to, activities such as using a non-existent email return address, spamming (sending unsolicited advertising to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user), or allowing spamming by third parties to promote a website, trolling (posting outrageous messages to generate numerous responses), mail-bombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, cross-posting articles to an excessive number o newsgroups, hacking ( unauthorized access to or use of data, systems, server or networks, including any attempt to probe, scan or test the vulnerability of a system or to breach the security thereof), spoofing (any attempt to impersonate any person or otherwise deceive or mislead through alteration of headers); deletion of author attributions, legal notices, or proprietary designations in an effort to deceive or mislead; forging or altering any TCP-IP packet header, email header or any part of a message header, using manual or electronic means to avoid any use limitations on you use of Y2k Service's servers such as timing out; sending or disseminating harassing email or chain letters; or use of flames (hostile attacks or invectives aimed at a group or an individual.

Spam

Y2k Service takes a no tolerance approach when dealing with spam and other types of UCE (unsolicited commercial email) Y2k Service defines spam as any type of unsolicited email used for any purpose. This includes, but is not limited to: Using a non-existent return email address when sending commercial solicitations. Mail-bombing (sending numerous messages to the same user). Subscribing someone else to a mailing list without that person's permission. Posting the same article to multiple newsgroups. Using another network to send spam that relates in any way to Y2k Service or any site hosted by Y2k Service (including your site). If a client is found in violation of the above no-spam policy, the offending account will be terminated without notice and no refund will be issued. There will also be a fee (payable in U.S. funds) charged to the client for each complaint received by Y2k Service. To report spam, please email webmaster@Y2kService.org.

Misuse of System Resources

You may not engage in any uses or activities that misuse Y2k Service's service or servers or system resources, including, but not limited to employing or posting programs which consume excessive CPU time or storage space; permitting use of mail services, mail forwarding capabilities, POP accounts, or auto responders other than for your own account; or resale of access to CGI scripts installed on Y2k Service's servers.

No Expectation of Privacy

You should be aware that, although privacy issues are very important to us, given the current regulatory and technical environment, you should not have an expectation of privacy in your use of any service, your account or any information associated with it.

Custom Support

When Y2k Service, Inc determines requested assistance falls out of the scope of the basic support Y2k Service, Inc. shall charge customer for use of the support on a one (1) hour incremental basis. Furthermore, when Y2k Service, Inc. determines a fee will be assessed to customer, Y2k Service, Inc. reserves the right to charge any or all of the fees prior to the commencement of any work being performed.

Third-Party Software

Additionally, in the event customer elects to install or seek assistance from Y2k Service, Inc. in connection with the installation of any third-party software, the following terms shall apply. Customer represent and warrant the right to use and install the third-party software, and have paid the applicable licensing fees for the third party software, and the third-party software does not and shall not infringe on the intellectual property rights of any other person or entity. You agree to defend, indemnify and hold harmless Y2k Service, Inc. and its employees, officers and directors for, from and against any and all claims brought against Y2k Service, Inc. and its employees, officers and directors by a third-party alleging the software infringes: (i) the third-party's rights; or (ii) a U.S. patent, trademark, copyright or other intellectual property right. Customer agree that in such an event Customer shall pay all resulting costs, damages, expenses and reasonable attorneys' fees that a court awards and settlements incurred by Y2k Service, Inc. in connection with any such claims.

Y2k Service, Inc. Rights

Y2k Service, Inc. explicitly reserves the right and sole discretion to:

1. modify its pricing.

2. establish limits and guidelines concerning the use of the services;

3. terminate customer use of the services for use of the services to unnecessarily or illegally harass Y2k Service, Inc. or third parties, non-payment of fees for the services, activities designed to defame, embarrass, harm, abuse, threaten, slander or harass third parties, activities prohibited by the laws of the United States and/or foreign territories in which You conduct business, activities designed to encourage unlawful behavior by others, such as hate crimes, terrorism and child pornography, activities that are tortuous, vulgar, obscene, invasive of the privacy of a third party, racially, ethnically, or otherwise objectionable in the sole opinion of Y2k Service, Inc., activities designed to impersonate the identity of a third party, activities designed to harm minors in any way, and other activities whether lawful or unlawful that Y2k Service, Inc. determines, in its sole discretion, to be harmful to its other customers, operations, or reputation;

4. terminate customer use of the services if Your use of the services results in, or is the subject of, legal action or threatened or proposed legal action, against Y2k Service, Inc. or any of its affiliates or partners, without consideration for whether such legal action or threatened or proposed legal action is eventually determined to be with or without merit; and

5. terminate customer use of the services at any time and for any reason if deemed reasonably necessary by Y2k Service, Inc.

Y2k Service, Inc. has no obligation to monitor customer use of the services, but reserves the right in its sole discretion to do so.
